Arbitration is an alternative form of dispute resolution outside the court process.
Many disputes, particularly those involving insurance policies, can be dealt with by arbitration. Frequently there is a term in the Insurance Policy that the matter must first go to arbitration before resorting to the courts.
Arbitration can often be a more efficient option than resorting to the court process – in that it is speedier and the Arbitrator chosen can be one who has specialist knowledge in the area of dispute.
The arbitration process is a private one, in which an independent third party – the Arbitrator – is appointed to decide the outcome of a disagreement or dispute between parties.
The arbitration itself is held in private, which obviously can be advantageous if the area of dispute is of a very personal or sensitive nature.
